>> prison inmates appear to be using that information to threaten grs. they are saying, we know where you live. we know where your family lives. >> jodi aryays, facing charges that she murdered her ex-boyfriend. but her defense team argues she acted only in self-defense. >> she changed her story.
10:02 pm
that is not consistent with self-defense. >> there was an epic struggle in that bedroom -- >> she's the one with the knife -- she's the one with the gun. come on. >> jumping and shouting for joy in june when he scratched off a million-dollar illinois lottery ticket. but the day after he collected his lump sum winnings, he was rushed to the hospital and died. >> final blood level came out. there was a lethal level of cyanide. >> the alabama quarterback led the team to victory. >> the guy who was announced in the game, bret musburger introduced her to the audience. >> you quarterbacks, you get all the good-looking women. if you are a youngster in alabama, start throwing the football around. >> he was the only suspect in custody in connection with the benghazi ferer attack, but he's been set free, let go. tunisia, ordering the release of
10:03 pm
the suspect, due to a lack of evidence. >> we have all that and much more for you tonight. but first, the family of retired fbi agent robert levenson releasing extraordinary photos of him as a hostage. he vanished into thin air on an iranian island. and two years ago, a hostage video, allegedly sent to the family, raising the possibility that he was being held by terrorists. but now, u.s. intelligence officials say the iranian government may be behind the video and the just-released photos. his wife is calling for added pressure on iran. she is here. good evening. >> hi, greta. thank you for having me. >> i am happy to have you here. every time we have you on the air, i think some day, we are going to be talking and your husband's going to be right next to you. the photos that have you released tonight give a lot of hope that your husband is still alive. i take it you believe he's still alive? >> i believe he is still alive.
10:04 pm
i believe that he is spending every waking hour making sure that he is well enough to come home to us. >> now, when you look at these pictures, do you have any idea when they may have been taken? are they dated in any way? >> i have not been able to find a date on these. i do think they were taken earlier than the video. only because i have been told that doctors have looked at the video and said that he could not possibly have grown hair like he has in this picture the way -- in the short amount of time between the pictures and the video. >> we don't show the hostage video. we are using the still pictures. but i am curious, when you look at the picture, do you have any doubt whatsoever that that's your husband. >> no. no. not at all. that is my husband. >> it was -- it was suggested by secretary of state clinton, at least a year ago, maybe almost 2 years ago, that he was being
10:05 pm
held in south asia. there was a suggestion that he might be held in pakistan, held by terrorists. do you know why she thought that? >> the email came from pakistan. that's why i believe we started looking at the possibility. but i don't believe that he is there. i believe he is still in iran. >> when you say email, you mean the email with those photos, is that right? >> correct. >> i know that an effort was made to try to find the source of the email. did you get any information at all as to who might have sent them to you? >> no. the email address was used one time and one time only. >> was it an email to you directly or to member else? >> it was directly to me. >> so, i mean, i guess that either -- i assume that the email was obtained from your husband, your email address. i assume that's how they got it. was that your assumption? >> i assumed so because he had
10:06 pm
that on his person when he disappeared -- or was taken. >> all right. so now there has been a shift. now the united states -- the state department believes -- and i don't know if you believe this as well -- that he is not being held by terrorists, but the iranian government or someone in iran? >> i do believe that the iranian government has my husband. >> when you go back in history, the last couple of years, the united states has been very aggressive to try to help get americans home. the three young college students, hikers who were there. are they trying to help you? what are they doing for you? >> well, the fbi -- the people working the case on a daily basis are fbi agents. and they have tried very hard to find out information about bob and get him returned to our family safely. unfortunately, that hasn't happened. they haven't been able to get the kind of information we would hope they would be able to
10:07 pm
obtain. diplomatically, it takes a long time for each diplomatic request to go through all the channels. i know over the course of all of these years that the government and the state departments have tried to do that but have been unsuccessful. i feel that there needs to be more attention to the case. and that's why i am putting these pictures out and trying to get everyone to -- to be reminded that bob is still missing. >> i assume there has been some communication, maybe not directly between the u.s. and iran, but through some other third nation. has iran ever made it a mission that they know where he is or they are holding him or want him for any particular reason? or have they denied flatly that they have him? >> the only time we ever received information about bob was in april of 2007 when a
10:08 pm
state-sanctioned station -- press tv published a page that said that bob was in iranian custody ands would be released in a few days. >> what can we do for you? and your family? >> i am just hoping that you will make sure that everyone is aware that he is not home, that all the other iranian americans and hern americans that have been held in iran have been returned home and bob has not. this is very frustrating. our oldest daughter is getting married in a month, we don't have any reason why bob is being held. we have no information about how to get him home. we know that iran can do that. >> have you spoken -- have you had a chance to speak directly to secretary of state clinton or president obama? >> vispoken to each of them. >> and they have said what? >> that they will do everything they can to help us get bob
10:09 pm
home. >> and what are they doing? >> i believe that they're working through diplomatic channels, as i said. the ones i know are working on a daily basis are the fbi agents. and they have been extremely diligent in uncovering anything they can dpiend about bob. >> i know that you have been very patient, your family's been very patient and you want the government to do everything. i hope the united states can step up the pressure. we don't like to leave americans overseas like that. anyway, thank you. nice to see you. come on back. >> thank you. thank you. >> now to new dangers from the recently published gun map, showing the names and addresses of new york gun owners. rockland county law enforcement saying the journal news map is putting their officers in the line of fire. they say jail inmates are taunting officer, threatening the officers that they may know the guards' home addresses. the rockland county sheriff is here.
10:10 pm
good evening. >> good evening. how are you? >> very well. give me an idea of what is happening with the threats? >> basically, the officers are on edge. it's really, like i said, it's uncalled for. and i want to put everything at ease. i would hope that the journal news would retract in thmap and put it away. i don't know what point they were trying to prove but they have caused a lot of disharmony within law enforcement and with the public at large. >> is it not too late -- now that it's publishd? you know, is there any way to remove it from the internet? it's an interactive map. 25% of the names and addresses are apparently wrong. what would you want them to do at this point? >> pull the map down. don't give the -- the criminal element the ability to continue to search that map. for law enforcement. law enforcement, when i say that, not only corrections, police, probation, parole officers, dea averages fbi
10:11 pm
agents, secret service, rockland county has a large number of law enforcement officials in the county. it also puts the public at risk. store owners and homeowners. >> have you spoken to the publisher or anyone at the newspaper? >> they did call me yesterday... to ask me to explain to them exactly what was transpiring with our correction officers because, you know, as they indicated, you can't pick out somebody's name and find them. i said, that's not the way it's working. they are going to the phone, calling home, calling fellow gang members, friends. they are identifying the names and they are going through the maps on their own and searching out where the officers might live. on top of that, we have almost 8,000 active and retired new york city police officers that live in rockland count i. -- >> did you get -- i'm sorry. go ahead. >> all of these people have done law-abiding things and enforced the laws of the state of new york and upheld the
10:12 pm
constitution. now they or their families are at risk. >> did you get the sex that they called you to find out what was wrong or are they looking for another story and getting a statement from the sheriff? >> you know what, i being they are trying to get another statement. but i am standing on one thing, and that's public safety. the safety of the public. that includes law enforcement personnel and the public at large. >> is there any indication that the newspaper is going to pull that map down. >> viseen no indication at all. i know our legislature is actually lobbying them to pull it off. the internet and off their sites. but i don't see any inication at this time that they are going to do that. >> sheriff, thank you, sir. >> you're welcome. >> and new york's putnam county, which is next to rockland county, is refusing to release the names and addresses of gun owners. putnam county district attorney adam leavy, calling it a matter of public safety. he joins us. >> good evening, greta. >> all right.
10:13 pm
i take it this is a public record. how are you preventing -- turning this over to the newspaper or whoever else requests it? >> this is absolutely a public safety issue, as you said. this is not a gun issue. we're complying with the law. the fact that names and addresses are public records, as you indicated, does not mean that under the public officers' law it needs to be turned over. that's not what the law says. there are exceptions in the law for the same reasons that the sheriff indicated. not only are there public safety issues for the law enforcement in rockland and westchester and putnam county and others. have you not only the licensed perm holders at risk, having their names and addresses on the map, but also their neighbor who is don't have guns and chose not to purchase guns and possess them lawfully because they become soft targets. there are absolute exceptions in the law. we are complying withplying witw and we would ask the journal
10:14 pm
news to withdraw their request. >> you are not going to do it because there are exceptions to the law. that's your position. i am curious -- maybe you don't know the answer. >> reporter: is the governor able to issue an executive order to change the public records or the law? or does it have to go through the legislature? can they do it on an emergency basis? >> my understanding is that there is a bill penning in the senate that passed to prevent this diap -- type of disclosure. this bill is held up in the assembly. we are okay on the law. we are okay with the case precedent and the statute itself. as far as i'm concerned, we are complying with the law, protecting the citizens, we are doing the jobs we are required to do under the constitution. >> is the publisher of the newspaper that published the county's records, is that paper asking you for your records? or have they abandoned that. >> it was before the hol holidays. yes, it's the same paper.
10:15 pm
>> have they backed off because of the cry from so many people? >> no, they made their request. our obligation under the law is to provide them in writing with our answer, which we will do. and then they have their opportunity to appeal that to the county executive. and after the county executive issues ther decision, the journal news can then bring it to the supreme court in putnam county and an article 78 proceeding, to request a supreme court judge reverse t. i believe we will be successful. >> you know what is even more bizarre, when i was talking to a rockland county representative, 25% of the records are wrong, people who may have lawfully registered a gun five or six years ago, may have moved to another county or state. the records -- the records of that type of error, 25%, i am curious, you know, why any of these records will be released until they can be checked out. what's being released is misinformation at best. >> greta, it seems that the
10:16 pm
journal news did not think this through very well. they didn't think it through on public safety ground, most certainly. they didn't think it through on legal grounds. and if they didn't think it through on safety or legal grounds, they didn't care if the information was accurate or not. they should reconsider their position. >> i suspect that they are going to back off trying to get it from you. it has created -- people have been pretty outraged. i suspect you are not going to hear from them again. >> it could be. that's probably their best move. we are not backing down. >> sir, thank you very much. >> thank you. >> there is grizzly new information from the t woman charged in the gruesome murder of her ex-boyfriend. jodi arias is accused of shooting, stabbing and slitting travis alexander's throat in the shower. she is claiming self-defense -- that's her third defense. the medical examiner testifying about the bloody attack and
10:17 pm
alexander's fatal wounds. >> the gunshot wound may have been last. but the gunshot wounds and the wound to have neck would have had to have come after the defensive wounds of the hands. >> former lapd detective mark fuhrman is here. what we didn't put up the information eye am sure the jury will hear -- is that the victim kept a blog. and his last entry, which is described as haunting, two weeks before the murder, he wrote about trying to find a wife. he said, this type of dating to me is like a very long job interview, desperately trying to find out if my date has an ax murderer penned up inside of her. what a haunting blog note. right? >> it's -- it's going to be very useful for the prosecution because the defense is saying this is self-defense because they claim he psychologically beat her. well, this kind of shows that travis, the victim, was thinking
10:18 pm
exactly that thing of her. and he was trying to distance himself from her. >> it's interesting. when you look -- i don't have the schematic of his wounds, but a number of stab wound, throat slashing and gunshot. that doesn't sound like someone that is the aggressor. that sounds like someone who himself might have had a self-defense, had the shoe been on the other foot. he likes like he has defensive wounds. >> you are exactly right. he's got the defensive wounds. she has none. she came over to his house. he didn't go to hers. but there is something interesting with her defense, greta. if she is going to claim self-defense, she will have to get up on the stand and testify and justify each and every wound and why. now, several of those wounds, he was already incapacitated on the ground, or on the shower floor or on the bedroom floor, bathroom floor, he was
10:19 pm
incapacitated. so self-defense isn't black and white like people think. there is a use of force for anybody using self-defense. once that threat is now stopped, you have an obligation under the law to cease and flee. you don't get to just kill the person because they did something that you felt was life threatening. >> all right. you said that she will have to take the stand, you mean tactically, the constitution doesn't require it, but in order to prove self-defense, she will have to get up. but if she gets up on the stand, she has a couple of problems. self-defense was not the first defense. her first defense was that she didn't do it, she didn't know anything about it. the second defense was that she was there and somebody else did it, but she can't identify the attackers. the third defense is self-defense. when you start to have multiple defenses, that's the hard sell to the jury, as to why you keep changing your defense. >> well, i don't know what the defense attorneys are going to do. if they don't put her on the stand for self-defense, when she
10:20 pm
is somebody claiming self-defense and takes both murder weapons and they have been disposed of somewhere between arizona and salt lake city, utah. so to say that -- that is ridiculous. and then you clean -- try to clean the crime scene. you try to destroy evidence. but what you said about these other two defenses, i am sure that the judge would probably prohibit the prosecution from bringing those up until she takes the stand and then she will open the door, regardless of the ruling. she will open the door and the prosecution will drive a train right through it. >> if she made those statements to police officers, whether she takes the stand or not, they will come after her. if she made three statements, i didn't do, i was there, but i don't recognize the people, and then it was self-defense. whether she takes the stabbed or not, it could be heard by the jury. mark, thank you. >> thank you. >> straight ahead a very

10:25 pm
he died of natural causes, but did he? a suspicious relative asked authorities to take another look. >> being that it's an ongoing investigation with the the police and state attorney i'd rather not say which family member was involved, but they did relay significant concern to our doctor that this may have been something other than a natural death and then we acted on that. a cyanide screen came back positive at which point, our office then contacted the chicago p.d. and they really geared up their investigation. >> greta: the lottery winner's death now ruled a homicide. his blood full of cyanide and an associated press reporter jason kaiser just spoke with his wife and he's here with the latest. what did his wife have to say? >> well, his wife was, i think, like a lot of people who watched the story unfold for the past few days since it broke. she's very -- she seems very distraught at the news that not only did she lose her
10:26 pm
husband, but he may have in fact been poisoned and killed. she said she seemed just not able to grasp that this could happen and she remembered her husband as a, you know, a very generous man who was always a businessman, he owned some dry cleaners in the area that he set up when he emigrated here from india, back in 1989 and he was also willing to help out others who were in need and in fact, would often donate money, send money back home to orphanages in his native india, so he ishe's baffd how a man like that could have any enemies, she doesn't believe it's possible that somebody could have been targeting him. >> greta: the lottery ticket, he got the ticket last july. he died last july.
10:27 pm
there was suspicious cast days after his religious burial and in november they concluded it was cyanide, homicide. and they're planning to exhume his body. do they know any reason why anyone would want to kill him? >> no, that's the baffling, one of the baffling things about this story, really, authorities have not put forward any theories as to why someone would want to kill this man. they haven't named any suspects or even said whether they have any suspects that they're looking for. they have not even said whether they think that, you know, a motive could be linked to the lottery win. so, there's not a lot to go on at this stage, but they are sticking by their revised conclusion that he was purposefully poisoned and that
10:28 pm
this was a homicide. >> greta: all right, and he won a million and went down to 600 for immediate payout. paid taxes down to 425. he died and then the money, about a couple weeks later goes to his heirs and his estate so his heirs have the money, correct? >> well, yeah, the check was cut. he died a day later. the money was paid out. because mr. kahn had no will, it went to his estate, but it's tied up at the moment in probate. so, you know, really nobody has collected it. >> greta: nobody has collected it yet. >> that's correct. >> greta: jason, thank you and we'll be following it, this certainly is a bizarre one. thank you. >> yeah, you're welcome. >> greta: and coming up, talk about nerve? remember how we, meaning the taxpayers, bailed out insurance giant aig from the brink of collapse? do you know what that company is now considering? suing us, taxpayers, what

wire, congresswoman maxine waters is ripping them apart as a lot of people are. did anyone force aig to take the bailout? >> no, that's one of the main arguments that the government made. no one forced aig's board back during the the financial crisis to take this bailout. they chose to take it, they chose to give the government an 80% stake. they chose to pay this loan with a high interest rate. no one really forced them to take it and that's sort of what the government says, it was entirely their choice. >> now, the government's out of their 80% stake, is that right? and what was the interest rate? >> the interest rate was pretty high. i don't feel the exact percentage, but the government itself has said that it was punitive and it was meant to be a punishment, it was meant to punish aig for getting in that situation where it had to be bailed out by taxpayers in the first place. >> did anyone feel like after all the american taxpayers, thank you, pr campaign and now we're sort of kicked in the teeth after we rescued them
